10.14.05 Spammers Nailed With $37 Million Fine By David Utter
A judge in Massachusetts has handed down a huge punishment to a spam gang operating
out of Boston and Russia and ordered their sites shut down.
The US-based sites run by Leo Kuvayev and his group have been shut down already,
but reaching those in Russia and other countries will be difficult. Still, the
judge in the case against Kuvayev's group has a little 'welcome back' present
for Kuvayev if he returns to the US: $37 million in fines.
The Boston Globe reported on the decision handed down by the court in response
to a complaint brought by the state's attorney general against the spammers. Kuvayev's
group sent out millions of spam messages and sold drugs, pirated software, and
pornography via numerous web sites.
Microsoft has assisted AG Thomas Reilly's investigation into the group's activities.
In May, Reilly obtained
an emergency court order to shut down those sites based on evidence gathered
while investigating Kuvayev's group.
Despite the court's decision, some still feel the CAN-SPAM Act has had no real
impact. ''If anything, it's gotten worse," said John Mozena, a cofounder and a
vice president of the Coalition Against Unsolicited Commercial E-mail, told the
Globe. ''CAN-SPAM has not had a visible effect on the amount of spam on the Internet."
